Background:
Last year, Council
refused an application that proposed the conversion
of an existing building containing 4 rental units to
one that would have added 3 additional units in the
basement with access at the side of the building
directly onto a laneway.
The decision was appealed
to the Ontario Municipal Board. The applicant then
revised his proposal to one that included 2 new
basement units (for a total of 6 units) with an FSI
of 1.36 and a new access from the front yard. City
Council did not support this latest proposal. The
OMB allowed the appeal in principal but will
withhold its final Order until concerns raised by
neighbours are addressed and the appropriate
agreements are executed. The OMB decision in this
case ran counter to previous decisions by City
Council and by the Committee of Adjustment. It also
was not in accordance with sound planning opinion
from city staff. It is a clear demonstration of the
great need for substantial OMB reform required from
the Provincial Government.
