The Ontario Municipal Board approved the Official Plan
and Zoning Amendments for the development at 45 York
Mills. After several re-hearings and clarifications, a
Site Plan Agreement between the City and the applicant
was signed and a building permit issued. Site
preparation work, however, resulted in vibrations that
shook homes as far away as hundreds of meters. Some
neighbours reported damage to their homes.
In response to those concerns, the City's Chief Building
Official issued a "stop-work" order with respect to the
activity causing vibrations pending an evaluation of
possible structural damage. While initial investigations
demonstrated cosmetic damage, further investigation may
be required to determine whether structural damage has
occurred. Pending further evidence, the "stop-work"
order was lifted and construction resumed.
It is clear that construction vibration is a continuing
problem that is not adequately addressed by the Ontario
Building Code. Consequently, City Council adopted a
motion by Councillor Walker and myself to draft a by-law
to regulate vibrations caused by construction activity.
